NOTICE OF APPROVAL AND AWARD OF GUARANTEED ENERGY SAVINGS AGREEMENT AMENDMENT BY THE ALLENTOWN SCHOOL DISTRICT Notice is hereby given pursuant to provisions of the Pennsylvania Public School Code of 1949, as amended; the Pennsylvania Sunshine Act of 1986, July 3, P.L. 388 No. 84, as amended; and the Guaranteed Energy Savings Act, Act 57 of 1998, Act 77 of 2004, Act 39 of 2010, and Act 163 of 2016 in Title 62, Chapter 37, Subchapter E, that the Board of School Directors of the Allentown School District will at a meeting to be held on Thursday, September 27, 2023 at 7:00 pm in the Administration Center Boardroom at 31 S. Penn Street, Allentown, PA 18105, take action to approve and accept an Guaranteed Energy Savings Agreement Amendment with McClure Company. The scope of work for the Guaranteed Energy Savings Agreement Amendment includes a 12-Month Preventative Maintenance Program, LED lighting upgrades, building envelope upgrades, indoor environmental quality monitoring, and replacement of Lehigh Parkway Elementary, Muhlenberg Elementary, Jefferson Elementary, and Raub Middle School targeted HVAC Equipment, including indoor air quality improvements. The Guaranteed Energy Savings Agreement Amendment provides that the cost of the work of $26,863,597. Funding from American Recovery Plan (ARP)/Elementary and Secondary School Emergency Relief (ESSER) programs will be used in part for this work. 

Act 39 Summary Report


As stated in ASD School Board Policy #610: Purchases Subject to Bid, the Board: will obtain competitive bids for products and services where such bids are required by law or where such bids may be believed to bring about a cost saving to the school district. For procurement of supplies or services pursuant to a federal award, the district's purchase of supplies or services, the aggregate dollar amount of which does not exceed $3000 (or $2000 in the case of acquisitions for construction subject to the Davis-Bacon Act), may be awarded without soliciting competitive quotations if the district considers the price to be reasonable.

The Board of Directors reserves the right to reject any or all bids, with or without cause.
